Cartel prohibition is a central point of Nigerian competition law which aims at protecting the internal market from any form of collusion between independent undertakings. Whilst Nigerian cartel regulations are relatively new and developing, the recent launch of cartel and broad investigations by the Federal Competition and Consumer Protection Commission into the activities of some players in the Nigerian shipping and freight and generating set industries reaffirms the Commission’s commitment to enforce the relevant cartel laws and regulations and potentially impose penalties which may range up to 10% of the annual turnover of the defaulting entity.
This publication provides a synopsis of the relevant laws regulating cartel activities in Nigeria, enforcement trends, applicable penalties, cross-boarder issues, reform proposals, amongst others.
